Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Pinapex ("Pinapex," "we," "us") governing your access to and use of the Pinapex website and application (together, the "Service"). By using the Service you accept these Terms. If you do not accept them, do not use the Service.

Pinapex helps creators and brands plan, schedule, and analyze content on Pinterest through Pinterest's official API. Some features require you to connect one or more Pinterest accounts via OAuth.

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorized access.

You may only connect Pinterest accounts that you own or are explicitly authorized to manage. By connecting a Pinterest account, you authorize Pinapex to call the Pinterest API on your behalf within the scopes you approved during OAuth. You may revoke this access at any time.

Your use of the Service must comply with Pinterest's Terms of Service, Community Guidelines, and Developer Guidelines.

You agree not to:

• Use the Service to send spam, deceptive content, or material that infringes intellectual property or other rights.
• Attempt to circumvent Pinterest's rate limits or anti-abuse mechanisms.
• Reverse engineer, decompile, or otherwise attempt to extract source code from the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to violate any applicable law or third-party rights.

You retain ownership of all content you upload to or publish through Pinapex ("Your Content"). You grant Pinapex a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and otherwise process Your Content solely as needed to provide the Service to you.

You represent that you have all rights necessary to use Your Content and that it does not violate any law or third-party right.

Some features of the Service may be offered for a fee. Any fees, billing frequency, and refund terms will be displayed at the time of purchase. Failure to pay may result in suspension or termination of paid features.

Pinapex and its licensors own all right, title, and interest in and to the Service, including all related trademarks, logos, and software. These Terms do not grant you any rights to our intellectual property except as expressly stated.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing the Service to you would be commercially impractical. Sections that by their nature should survive termination (for example, ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Pinapex disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

To the maximum extent permitted by law, Pinapex and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total cumulative liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Pinapex in the twelve months preceding the event giving rise to the claim, or USD 100, whichever is greater.

You agree to defend, indemnify, and hold Pinapex harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

We may update these Terms from time to time. Material changes will be announced on this page and, where appropriate, by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which Pinapex is established, without regard to its conflict of laws principles. Disputes will be resolved in the courts of that jurisdiction unless a different forum is required by applicable law.
